Website Terms
of Use.

1. Purpose and scope

These Website Terms of Use concern access to the Playcrest website, its editorial and portfolio materials, and its local project-brief tool. The website introduces mobile acquisition, creative and measurement services to mobile game studios and publishers. It does not provide a self-service advertising account, an online checkout or a hosted client application.

The terms describe permitted use of the website. They do not themselves create a paid service engagement, an advertising-platform relationship or a data-processing mandate. Any provision applies only to the extent permitted by the law governing the relevant situation.

2. Business use and authority

You may browse the public pages to evaluate the services and ideas described. If you communicate on behalf of a business, you are responsible for having the authority to make the relevant enquiry and share the information it contains.

The website is intended for professional and business use. It is not intended to offer games or accounts to children. No statement on this page removes a mandatory right that applies to an individual consumer or other protected person.

3. Website information and professional judgement

Service descriptions, articles and examples explain a general approach. They are not a proposal tailored to your product, a complete implementation specification or advice on which a particular advertising investment should depend without further assessment.

An advertising decision can depend on product quality, market conditions, platform rules, budget, creative, measurement quality and user behaviour. Confirm current platform requirements and assess whether an approach is suitable for your circumstances before acting. Website material is not individual legal, tax, accounting or investment advice.

Reasonable care is taken in presenting information, but platform features and commercial conditions can change. The website may be updated to correct an error or reflect a change; the presence of older material does not guarantee that a platform still offers the described feature.

4. Enquiries and formation of an engagement

A website visit, prepared brief or preliminary conversation does not book capacity, place an order or create an obligation to deliver services. The local brief tool prepares text on your device; it does not send the information to the agency or generate an acknowledgement of receipt.

A paid engagement requires a separate agreement with the contracting party. That agreement should identify the parties, scope, deliverables, timetable, fees, advertising spend, permissions, approval process, confidentiality, intellectual-property arrangements, data responsibilities and applicable termination provisions.

Any agency fee, media budget, third-party charge, invoice or refund arrangement must be expressly agreed for the engagement. No payment is collected by this website. A separate signed agreement governs its own subject matter if it differs from general website information.

5. Use of the brief tool

You choose what to enter and are responsible for checking the finished draft before copying or sending it elsewhere. You can amend the fields and regenerate the draft. Browser validation does not verify your identity, commercial authority or the accuracy of a project description.

Preparing the draft does not create an account or save a server-side copy. Choosing Copy brief uses your device clipboard; the website cannot control clipboard history, browser autofill, extensions or information you later paste into another service. Opening your email application transfers the prepared text to that application; review and send it there. No response time starts merely because a draft has been prepared.

Do not include account passwords, payment details, confidential customer exports or sensitive personal information. Request an agreed secure transfer method if such information is necessary for a later engagement.

6. Acceptable use

Use the website lawfully and in a way that respects other people’s rights and the availability of the service. In particular, you must not:

• attempt unauthorised access, evade access restrictions, introduce malicious code or deliberately disrupt the website or its infrastructure;
• impersonate another person or business, misrepresent your authority, or use website material to create a misleading affiliation;
• copy, redistribute or exploit protected content beyond the permission in these terms or another applicable permission;
• use automated requests at a volume that unreasonably interferes with ordinary access, or bypass technical measures intended to prevent misuse;
• send unlawful, infringing or abusive material through a separate contact channel, or disclose another person’s confidential information without authority.

These restrictions do not prohibit activities that applicable law expressly permits, including lawful accessibility tools, ordinary search indexing or protected security research. Permission for a specific test should be agreed before it creates a risk to systems or other people’s data.

7. Website materials and intellectual property

To the extent protected by applicable intellectual-property law, the website’s original text, visual presentation, brand elements and other materials are owned by or used with permission from the relevant rights holders. Third-party names, marks, products and licensed assets remain subject to their own rights and licences.

You may view the website and make reasonable copies for your internal evaluation of the services, retaining relevant ownership notices. This does not grant a right to resell the materials, publish the site as your own, use its brand identity for another business or reuse a portfolio concept in a live campaign without permission.

Rights in deliverables created for an actual client engagement are agreed separately. Nothing here transfers a client’s pre-existing assets or overrides applicable open-source, font or other third-party licence terms. Ideas and materials that are not legally protected are not made exclusive merely by appearing on this website.

8. Portfolio studies and illustrative material

Portfolio entries identified as original creative directions are authored studies. They illustrate a visual idea, a product story or a potential creative approach. They are not presented as independently verified client testimonials, published case-study results or evidence of an actual advertising spend.

Product imagery, app screens, game worlds and advertising-placement examples may be illustrative or produced with creative software, including AI-assisted tools. Their appearance does not establish that a depicted application is available to download, that a depicted location is a company office or that a brand shown has commissioned the work.

Descriptions of a possible test or next experiment are proposals for exploration, not reports of a test already performed. Any real result supplied during an engagement should be interpreted with its data source, reporting window, attribution method and limitations.

9. Third-party platforms and names

References to Meta, Facebook, Instagram, Google, YouTube, Google Play, AppsFlyer and Adjust describe advertising or measurement contexts. Their names and trademarks belong to their respective owners. A reference on this website does not, by itself, establish a partnership, certification, endorsement or permission to act for a platform.

Each platform applies its own current terms, policies, eligibility rules and technical requirements. Platform approval, account status, campaign delivery and attribution availability are controlled by the relevant provider. No agency can guarantee a platform’s approval simply through wording on this website.

External links, if provided, are for information. You choose whether to follow them, and the destination’s own terms and privacy practices then apply. Descriptive install, play or advertisement labels inside an illustration are not live platform controls.

10. Accounts, access and client data

This website does not request or authorise access to an advertising account, app store account, attribution dashboard or customer database. A future engagement must identify the account owner, the permitted users, the level of access and the work for which access is granted.

Use official platform invitations and proportionate permissions rather than sending credentials in a website brief. Campaign assets, app-event information and client datasets should be shared only through agreed channels and with the necessary rights and legal grounds.

Where an engagement involves personal information, the respective roles and any required data-processing terms must be settled for that work. A mention of measurement services here does not make this website a processor of all data from a visitor’s app or advertising accounts.

11. No guaranteed advertising outcome

Campaign results are affected by factors outside the control of an agency, including the product experience, competition, pricing, creative performance, platform decisions, available measurement and market conditions. The website does not guarantee installs, rankings, user retention, advertising approval, acquisition cost, revenue, return on advertising spend or profitability.

An estimate, scenario, illustrative creative or proposed experiment is not a promise of a particular result. Goals, reporting methods, review periods and the treatment of uncertainty should be agreed in the relevant engagement. This section does not excuse failure to meet a specific obligation expressly accepted in that agreement.

12. Availability and changes to the website

Pages and features may be updated, replaced or temporarily unavailable for maintenance, security, correction or operational reasons. The website is not a guaranteed archive, a record-storage service or a substitute for keeping your own copy of an important brief or agreement.

Technical measures may be used to address misuse or protect availability, subject to applicable law. Changes to the public website do not, by themselves, cancel or alter an existing client agreement. Access and service commitments under such an agreement are determined by its own terms.

13. Responsibility and limits of liability

You remain responsible for evaluating general website information before using it for a particular commercial decision and for information you choose to share through another channel. Except where a specific commitment is made, no promise is given that the public website will be uninterrupted, error-free or suitable for every particular purpose.

To the extent applicable law permits, liability is not accepted under these website terms for indirect or consequential business losses caused by reliance on general website material, or for the independent acts of a third-party platform. Liability for services actually contracted is governed by the relevant agreement and applicable law.

Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, including applicable liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or a mandatory consumer or data-protection remedy. A limitation is not to be interpreted as a waiver of those rights.

14. Privacy and information handling

The Privacy Policy explains the local brief tool, technical website requests, browser storage, provider involvement and relevant choices. These website terms do not turn a privacy acknowledgement into consent to unrelated processing.

If you contact the agency independently, share only information relevant to the conversation and that you are entitled to provide. The confidentiality and permitted use of materials for a paid engagement should be addressed in the agreement for that work.

15. Applicable law and resolving concerns

The applicable law and competent courts are determined by the legal rules relevant to the parties and the dispute, unless a valid separate agreement provides otherwise. A separate choice of law or court applies only to the extent it is valid and does not remove protections that cannot be waived. These terms do not require mandatory arbitration.

For a concern about website material or operation, identify the relevant page, the issue and the resolution you seek through an available direct contact channel. An informal discussion may help resolve a concern, but it is not a mandatory prerequisite to a statutory complaint, urgent remedy or other right.

If a provision is found invalid or unenforceable, it should be applied only to the extent the law permits; the remaining provisions continue to apply where possible. Failure to enforce a provision on one occasion does not automatically waive it on another.

16. Revisions and contact

The revision date is shown at the beginning of this document. Updates take effect for future website use from the stated date, subject to any notice or other requirements imposed by applicable law. An update does not retrospectively rewrite a separately agreed client engagement.

Contact information and the brief tool are available on the contact page. The brief tool prepares a local draft and does not deliver correspondence. Check that you are using an operational direct channel when you need to send an enquiry, a legal notice or a privacy request.
